Celui-ci g\u00e8re lui-m\u00eame son dossier de la <strong>transmission des documents<\/strong> \u00e0 la CPAM jusqu\u2019au <strong>versement des IJSS<\/strong>. L\u2019employeur peut toutefois maintenir \u00e0 l\u2019employ\u00e9 la <strong>totalit\u00e9 ou une partie de son salaire<\/strong>, et percevra alors lui-m\u00eame directement les IJSS. On dit alors qu\u2019il y a <\/span><span style=\"font-size: 12pt; font-family: 'Lato'; font-weight: bold;\">subrogation<\/span><span style=\"color: #000000; font-weight: 400; text-decoration: none; vertical-align: baseline; font-size: 12pt; font-family: 'Lato'; font-style: normal;\">. (Article R. 323-11 du code de la s\u00e9curit\u00e9 sociale). <\/span><\/p>\n<p>&nbsp;<\/p>\n<p style=\"margin: 0; color: #000000; font-size: 11pt; font-family: 'Arial'; line-height: 1.0; orphans: 2; widows: 2; text-align: justify; padding: 12pt 0 12pt 0;\"><span style=\"color: #000000; font-weight: 400; text-decoration: none; vertical-align: baseline; font-size: 12pt; font-family: 'Lato'; font-style: normal;\">La <strong>subrogation<\/strong> est mise en \u0153uvre sous certaines conditions. Dans un premier temps, il doit avoir un <strong>maintien du salaire int\u00e9gral ou partiel<\/strong> pendant la dur\u00e9e du travail ou du cong\u00e9. Dans un second temps, la part du salaire maintenu doit \u00eatre d\u2019un montant <strong>au moins \u00e9gal \u00e0 celui des IJSS<\/strong> dues au salari\u00e9 par la CPAM. <\/span><\/p>\n<p>&nbsp;<\/p>\n<p style=\"margin: 0; color: #000000; font-size: 11pt; font-family: 'Arial'; line-height: 1.0; orphans: 2; widows: 2; text-align: justify; padding: 12pt 0 12pt 0;\"><span style=\"color: #000000; font-weight: 400; text-decoration: none; vertical-align: baseline; font-size: 12pt; font-family: 'Lato'; font-style: normal;\">Ainsi, dans l\u2019hypoth\u00e8se o\u00f9 l\u2019employeur d\u00e9cide de maintenir le salaire de son employ\u00e9 <strong>sans subrogation<\/strong>, le salari\u00e9 per\u00e7oit de la part de la CPAM, les IJSS auxquels il a droit, et \u00e0 cela s\u2019ajoute le <strong>compl\u00e9ment de salaire<\/strong> vers\u00e9 par son employeur dans le cadre du maintien de salaire.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p style=\"margin: 0; color: #000000; font-size: 11pt; font-family: 'Arial'; line-height: 1.0; orphans: 2; widows: 2; text-align: justify; padding: 12pt 0 12pt 0;\"><span style=\"color: #000000; font-weight: 400; text-decoration: none; vertical-align: baseline; font-size: 12pt; font-family: 'Lato'; font-style: normal;\">A l\u2019inverse, dans l\u2019hypoth\u00e8se d\u2019une <strong>subrogation de l\u2019employeur<\/strong> dans les droits aux IJSS du salari\u00e9, le salari\u00e9 re\u00e7oit un seul virement de la part de son employeur \u00e0 hauteur du montant pr\u00e9vu pour le maintien du salaire (incluant donc le montant IJSS). <\/span><\/p>\n<div class=\"info-box\" style=\"width: 100%;border: #000000 0px solid\"><div style=\"padding: 8px 30px 10px 30px;border-radius:5px; color: #3C484E; padding: 8px 30px 10px 30px; background: #fdefe1 url(http:\/\/www.yourDomain.com\/image-dir\/) no-repeat 10px 50%;\"><span role=\"image\" aria-label=\"\ud83d\udc49\">\ud83d\udc49<strong>A savoir : <\/strong><\/span><span style=\"color: #000000; font-weight: 400; text-decoration: none; vertical-align: baseline; font-size: 12pt; font-family: 'Lato'; font-style: normal;\">la subrogation intervient de plein droit lorsque l\u2019employeur maintien la totalit\u00e9 du salaire de son employ\u00e9.
